Erie City Council Adopts Cell Phone Ban
Beginning January 5, it will officially be illegal for you to use a hand-held cell phone while driving within Erie city limits. Wednesday morning, members of Erie City Council voted to adopt a local law, banning the use of cell phones while driving. According to the city clerk, the law will go into effect January 5. It will be illegal for you to use a hand held cell phone in any fashion while driving. That includes talking and texting. This is expected to be a secondary offense. That means, police will not be able to pull you over simply for using a hand held cell phone while driving. But, if you're caught speeding, running a red light, or violating any other traffic law, and you're seen using your cell phone, then you're going to be fined for that infraction as well. Fines for violating the cell phone ban could go as high as $300. State legislators had asked local leaders to hold off on passing municipal cell phone bans as they work to approve a state-wide ban. Members of Erie City Council said they do feel it is a public safety issue, but they're also hoping today's action will send a message to legislators to pass a statewide law.
